Acceptance of Terms

By downloading, installing, or using SoundCheck ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of SoundCheck, including free-tier users, single-playlist purchasers, and Pro subscribers. These Terms are a legal agreement between you and the developer of SoundCheck ("we," "us," or "our").

These Terms should be read alongside our Privacy Policy, which is incorporated herein by reference.

Description of Service

SoundCheck is an iOS application that:

• Scans your Apple Music playlists to identify songs that are no longer available in the Apple Music catalog
• Suggests replacement tracks from the Apple Music catalog for unavailable songs
• Creates new playlists in your Apple Music library containing available songs and chosen replacements
• Maintains a local history of restored playlists for future reference

SoundCheck is an independent application and is not affiliated with, endorsed by, or sponsored by Apple Inc. Apple Music availability and catalog content are determined solely by Apple and music rights holders.

Plans & Pricing

SoundCheck is available in three tiers:

Prices are in USD and may vary by region based on App Store pricing. Current prices are always displayed in the App Store and within the app before any purchase.

Subscriptions & Billing

Pro Monthly ($2.99/month) and Pro Annual ($9.99/year) are auto-renewing subscriptions managed entirely by Apple through the App Store.

• Your subscription renews automatically unless cancelled at least 24 hours before the end of the current billing period.
• You will be charged through your Apple ID account at confirmation of purchase.
• You can manage or cancel your subscription at any time in your iOS Settings under your Apple ID → Subscriptions.
• No refunds are issued for partial subscription periods, except where required by applicable law.

Single Playlist ($0.99) is a non-refundable consumable in-app purchase that grants one full playlist scan and restore. It is not a subscription and does not renew.

Eligibility

You must be at least 13 years of age to use SoundCheck. By using the App, you represent that you are 13 or older. If you are under 18, you represent that you have parental or guardian permission to use the App and agree to these Terms.

You must have a valid Apple ID to use the App. You are responsible for maintaining the security of your Apple ID and for all activity associated with it.

SoundCheck is available only on iOS devices running iOS 16 or later. Compatibility is not guaranteed on all devices or operating system versions.

Apple Music Requirement

SoundCheck requires an active Apple Music subscription to access playlist data and search the Apple Music catalog for replacements. SoundCheck is not responsible for any limitations, changes, or unavailability of the Apple Music service.

You must grant SoundCheck permission to access your Music Library when prompted. Without this permission, the App cannot function. You can revoke this permission at any time in iOS Settings → Privacy & Security → Media & Apple Music.

Song availability in the Apple Music catalog changes over time due to licensing agreements between Apple and music rights holders. We make no guarantees regarding the availability of any specific song or that a replacement will be found for any missing track.

Acceptable Use

You agree to use SoundCheck only for its intended purpose and in accordance with these Terms and all applicable laws. You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Circumvent, disable, or otherwise interfere with security-related features of the App
• Use the App in any manner that could damage, disable, or impair our services
• Attempt to gain unauthorized access to any part of the App or its related systems
• Use automated scripts, bots, or other tools to interact with the App in an unintended manner
• Redistribute, resell, or sublicense the App or any of its components
• Use the App to violate any third party's rights, including Apple's Terms of Service

We reserve the right to terminate your access to the App if you violate these Terms.

Intellectual Property

SoundCheck, including its design, code, branding, and all associated content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use SoundCheck on your personal iOS device solely for your personal, non-commercial use, subject to these Terms.

Music track titles, artist names, album artwork, and catalog data accessed through Apple Music are owned by Apple, music labels, and artists respectively. SoundCheck does not claim any ownership over music content.

You may not use our name, logo, or branding without prior written permission.

Disclaimers

We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses or other harmful components
• Any specific song will be identified as missing or available — this depends on Apple Music's catalog
• A suitable replacement will be found for any missing track
• Restored playlists will contain exactly the tracks you expect — catalog availability changes
• The App will be compatible with future iOS versions or Apple Music updates

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from:

• Your use of or inability to use the App
• Changes to the Apple Music catalog affecting the App's functionality
• Loss or corruption of playlist data
• Unauthorized access to your data
• Any other matter relating to the App

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law. In such cases, our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

Termination

You may stop using SoundCheck at any time by deleting the App from your device. Deleting the App cancels your access but does not automatically cancel any active Pro subscription — you must cancel your subscription separately through your iOS Settings.

We may suspend or terminate your access to the App immediately, without prior notice, if you breach these Terms or if we decide to discontinue the App. Upon termination, your license to use the App ends immediately.

We are not obligated to provide advance notice before discontinuing the App or any of its features. If we discontinue the App, you may be entitled to a refund of any prepaid subscription fees under Apple's App Store refund policies.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except that either party may bring a claim in small claims court. You waive any right to a jury trial or to participate in a class action lawsuit.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For significant changes, we will provide notice through the App or App Store update notes.

Your continued use of SoundCheck after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
